Acceptance of Terms

By accessing or using Practice Sight Reading (the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you disagree with any part of the Terms, then you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

User Accounts

Account Creation: To access certain features of the Service, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. Practice Sight Reading reserves the right to suspend or terminate your account if any information provided during the registration process or thereafter proves to be inaccurate, not current, or incomplete.

Password Security: You are responsible for maintaining the confidentiality of your account password and for any activities that occur under your account. You agree to:

Keep your password secure and confidential.
Not permit others to use your account.
Immediately notify us of any unauthorized use of your account or any other breach of security.

User Conduct: You agree to abide by all applicable laws and regulations and to be solely responsible for all acts or omissions associated with your account. Prohibited activities include, but are not limited to:

Sharing your account credentials with others.
Attempting to access another user's account.
Engaging in any activity that disrupts or interferes with the Service.

Payment Terms

Billing Options: Practice Sight Reading offers two billing options for accessing the Service: monthly and yearly subscriptions. By selecting a billing option, you agree to the following terms:
- Monthly Subscription: Your account will be billed on a monthly basis. The subscription fee will be charged automatically to the payment method associated with your account each month unless you cancel your subscription.
- Yearly Subscription: Your account will be billed on an annual basis. The subscription fee will be charged automatically to the payment method associated with your account each year unless you cancel your subscription.
Free Trial: New users are eligible for a 7-day free trial of the Service. During the free trial period, you will have full access to the Service's features and functionalities. If you choose to cancel your subscription during the free trial period, you will not be charged at the end of the trial period.
Cancellation and Changes: You may change or cancel your subscription at any time by accessing the "Profile" section of your account settings. Changes to your subscription plan, including upgrades or downgrades, will take effect immediately. If you cancel your subscription, you will retain access to the Service until the end of the current billing period, after which your account will be deactivated.
Billing and Payments: By providing payment information to Practice Sight Reading, you agree to pay all applicable fees associated with your selected subscription plan. All fees are non-refundable except as expressly set forth in these Terms or as required by applicable law.
Taxes: You are responsible for all applicable taxes associated with your use of the Service.

Intellectual Property Rights

Ownership of Generated Content: Any music compositions, melodies, rhythms, or other audio content generated using Practice Sight Reading(the "Generated Content") are owned by the user who created them. Practice Sight Reading claims no ownership rights over the Generated Content produced by users of the Service.
License to Use: By using the Service, you grant Practice Sight Reading a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display the Generated Content solely for the purpose of operating, promoting, and improving the Service.
User Content: You may upload, submit, store, send, or receive content through the Service, including but not limited to audio files, text, images, or any other material (collectively, "User Content"). You retain ownership of any intellectual property rights that you hold in the User Content. By uploading, submitting, storing, sending, or receiving User Content, you grant Practice Sight Reading a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display such User Content solely for the purpose of operating, promoting, and improving the Service.
Third-Party Content: The Service may allow you to access and use third-party content, including but not limited to audio samples, audio fonts, loops, or other musical elements ("Third-Party Content"). Practice Sight Reading does not claim any ownership rights over Third-Party Content. Your use of Third-Party Content is subject to the terms and conditions set forth by the respective third-party providers.
Copyright Policy: Practice Sight Reading respects the intellectual property rights of others and expects users of the Service to do the same. If you believe that your copyright or other intellectual property rights have been infringed upon, please contact us with a detailed description of the alleged infringement.

Usage Restrictions

When accessing or using Practice Sight Reading, you agree not to engage in any of the following prohibited activities:

Unauthorized Use: Use the Service for any illegal purpose or in violation of any laws or regulations.
Interference: Interfere with or disrupt the Service or servers or networks connected to the Service, including transmitting any worms, viruses, spyware, malware, or any other code of a destructive or disruptive nature.
Unauthorized Access: Attempt to gain unauthorized access to any portion of the Service, other accounts, computer systems, or networks connected to the Service, through hacking, password mining, or any other means.
Data Scraping: Use any automated system, including but not limited to bots, crawlers, or spiders, to access or collect data from the Service without prior written consent from Practice Sight Reading.
Reverse Engineering: Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service or any software used in connection with the Service.
Unauthorized Distribution: Distribute, sublicense, lease, lend, sell, or otherwise transfer access to the Service to any third party without prior written consent from Practice Sight Reading.
Misuse of User Data: Misuse, manipulate, or exploit any user data or information obtained through the Service, including but not limited to personal information of other users.
Impersonation: Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
Content Restrictions: Upload, post, transmit, or otherwise make available any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
Violations of Terms: Violate any of the terms and conditions of these Terms of Service.

Your privacy is important to us. Practice Sight Reading is committed to protecting the privacy and security of your personal information. Termination and Suspension

Practice Sight Reading reserves the right to suspend or terminate your access to Practice Sight Reading and/or your account immediately, without prior notice or liability, for any reason whatsoever, including but not limited to the following:

Breach of Terms: Violation of any provision of these Terms of Service or any other agreement between you and Practice Sight Reading.
Illegal or Improper Conduct: Engaging in conduct that Practice Sight Reading determines to be illegal, fraudulent, or otherwise improper.
Security Concerns: Security concerns, including but not limited to sharing your account credentials with others or allowing unauthorized access to your account.
Abuse of Service: Engaging in conduct that disrupts or interferes with the proper functioning of the Service or the experiences of other users.
Non-payment: Failure to pay any fees or charges associated with your use of the Service.

Upon termination or suspension of your account, your right to access and use the Service will immediately cease. All provisions of these Terms of Service which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Liability and Disclaimers

Limitation of Liability:
- Practice Sight Reading shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service; (c) any content obtained from the Service; and (d) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not Practice Sight Reading has been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
No Warranty:
- The Service is provided on an "as-is" and "as available" basis, without any warranty of any kind, either express or implied. Practice Sight Reading disclaims all warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy.
No Professional Advice:
- Practice Sight Reading does not provide any professional advice or recommendations through the Service. Any information or content provided through the Service is for informational purposes only and should not be construed as professional advice.
Third-Party Services:
- Practice Sight Reading does not warrant, endorse, guarantee, or assume responsibility for any product or service advertised or offered by a third party through the Service or any hyperlinked website or service, and Practice Sight Reading will not be a party to or in any way monitor any transaction between you and third-party providers of products or services.

Governing Law and Dispute Resolution

Governing Law: These Terms of Service shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
Dispute Resolution: Any dispute, controversy, or claim arising out of or relating to these Terms of Service, or the breach, termination, or validity thereof, shall be settled by arbitration in accordance with its Commercial Arbitration Rules, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.
Jurisdiction: The exclusive jurisdiction and venue for any legal action arising out of or related to these Terms of Service shall be the state and federal courts located in the United States. You hereby submit to the personal jurisdiction of such courts and waive any objection to the exercise of jurisdiction by such courts on any basis, including without limitation, forum non conveniens.
